Ethics and Compliance Checkup

Brightline Compliance's team of attorneys and other experts can conduct an "Ethics and Compliance Checkup" to ensure your organization has established and maintained an effective ethics and compliance program. Brightline will provide a structure for you to examine your industry, the states and countries where you operate, the types of workers you employ, previous complaints and violations, and other factors to help you assess your risks. Brightline will then provide advice on how to prioritize the actions you should take to minimize your risks.

Brightline will assess your organization's progress against the standards set forth in the Federal Sentencing Guidelines and other relevant statutes, cases and guidance. The Federal Sentencing Guidelines explicitly define the following seven minimally-required elements of an "effective compliance and ethics program."

  1. Establish standards and procedures to prevent and detect criminal conduct
  2. Place responsibility with the organization's governing authority and high-level personnel to ensure that the organization's compliance and ethics program is effective
  3. Preclude persons who have engaged in illegal or unethical actions from serving in high ranking positions
  4. Audit, monitor, and periodically evaluate the program's effectiveness, and provide a way for employees to report concerns about illegal behavior without fear of retaliation
  5. Provide incentives to employees and agents to not act illegally or unethically, and discipline those who do
  6. Take reasonable steps to respond to misconduct and to prevent future misconduct
  7. Conduct effective training programs and otherwise disseminate information appropriate to such individuals' respective roles and responsibilities

In addition, Brightline will assess your organizations progress against the benchmarks and guidelines established by the Open Compliance and Ethics Group (OCEG). OCEG is a nonprofit organization that brings together business and industry-leading compliance solutions providers to develop standards, benchmarks, and other tools to help organizations meet their governance, risk management, compliance and ethics needs. As a member of OCEG's Leadership Council, Brightline stays abreast of and provides input into the best practices established by OCEG. 

The Leadership Council is responsible for guiding and shaping OCEG's overall mission, vision, and statement of principles. It is also responsible for identifying OCEG's objectives and priorities.
