Reasonable Accommodation of Disabilities

Millions of people in the United States have some type of physical or mental disability, and individuals with disabilities are an integral part of the workforce. The Americans with Disabilities Act and similar state laws prohibit employers from discriminating against qualified individuals with disabilities. These laws also require employers to make reasonable accommodations to qualified individuals with disabilities as long as doing so would not create an undue hardship on the employer. An accommodation is any change or adjustment to a work environment or work policy that allows a disabled person to perform the essential functions of the position. An employer's failure to reasonably accommodate an employee's disability can lead to lawsuits and multi-million dollar verdicts and settlements against it.

Most employers have adequate policies on reasonable accommodations. However, such policies are not effective unless all supervisors and managers have been trained how to properly apply those policies to the situations that they may encounter in real life.   • Can I ask an applicant or employee to provide documentation of his or her disability?
  • How do I balance an employee's request for a reasonable accommodation with the business needs of my organization?
  • What are my responsibilities for maintaining the confidentiality of disability-related information?
